Summary:
The respondent was a system operator in northern Hualien. In its "Yao Ni Hao K'an" promotional campaign in August and September 1997, the respondent's advertisement contained a prominent headline reading "Taiwan's No. 1, Hualien's No. 1 Cable TV System...in system construction, customer service, program planning and legal operation..."
The Fair Trade Commission investigated the competition among cable TV system operators in the Hualien area. When publishing its advertisement, the respondent claimed that it was ahead of the other system operators in optic fiber construction and provided better channels. The respondent admitted that the expression of “No. 1” was meant an objective for itself rather than any comparative statistic. The FTC found that the respondent had made a false statement by asserting that it offered a comprehensive advantage over other system operators and falsely presented itself as being “Taiwan's No. 1, Hualien's No. 1 Cable TV System.”
In conclusion, the FTC decided that the respondent violated Article 21(3) of the Fair Trade Law by making false, untrue and misleading presentation in its advertisements where Article 21(1) applies mutatis mutandis.
