Summary Report of updated APEC Competition Policy and Law Database

I. The Fulfillment of the APEC Competition Policy and Law Database

It has also been the privilege of Chinese Taipei to inform the APEC member economies about the progress of maintaining the APEC Competition Policy and Law Database.

After our last report to this group, our Database has not only been updated by most old member economies on a regular basis, but also been enhanced by the efforts from new member economies. We appreciate very much for the relevant agencies in Peru, Vietnam and Russia for their contribution on providing documents and information so as to make the Database comprehensive. We are glade to announce that at current stage, we have a complete competition database covering whole APEC geographic areas available for public access.

The completion of this database demonstrates the close cooperative relationship that exits among member economies for the accomplishment of the first section of collection actions in the Osaka Action Agenda. Not only can member economies promote dialogue and study other APEC member economies' competition policies and/or laws through this database, the private sector, including academic organizations and business enterprises, will also be able to retrieve useful information from the database for improving trade and investment.

II. Future Cooperation From Member Economies

With the establishment phase of the database completed, the main task now is its maintenance. Again Chinese Taipei is very appreciated for those member economies, including Australia, Canada, People's Republic of China, Japan and Thailand, for their active and cooperative provision of the updated information in the past year. We perhaps are also obliged to indicate that currently some member economies, including Brunei Darussalam; Chile; Hong Kong, China; Indonesia; Republic of Korea; Malaysia; Mexico; New Zealand; Papua New Guinea; Peru; Republic of the Philippines; Russia; Singapore; United States of America; and Vietnam are still yet to submit the updated information to Chinese Taipei. Chinese Taipei emphasizes that it is extremely important for every member economy to provide full support to the Database by providing updated information in a timely manner to ensure that all information in the Database is up-to-date and that users should feel comfortable to resort to it.

As we have all known that there have been cooperative workshops sponsored jointly be the APEC and the OECD on regulatory reforms. Since it is the purpose of the Database to provide complete information on competition matters having connection with APEC member economies, it would be very useful to include papers presented at the seminars in our Database. We propose that member economies agree with us to have those papers being put forth on our Database in a specially designated section so as to enrich the content and to enhance the usefulness of it. Of course, we shall consult with the OECD to obtain an agreement about the conditions of publishing the papers in our Database.
