Progress Since June

Over the last three months, Chinese Taipei continues to receive member economies' progressive data input for the APEC Competition Policy and Law Database (the Database). Member economies not only update their information of the first six categories (please refer to Attachment I for details of categories), but also contribute to adding new information for categories 7-14. We would like to express our gratitude to all member economies. So far, the principal categories (01-06) including member economies' competition policies and related regulations are completely available for public access. However, some categories on three member economies' pages of the Database still need to be improved. We would urge those economies whose pages are not completed (categories 01-06) to continue transmitting this required information or sending us a description of the status as early as is practical. For the well-established information included in the Database, we hope that economies could update the information quarterly. The status of data transmission associated with each member economy is included in Attachment.

New Feature of the homepage

Since the last CTI meeting, Chinese Taipei has designed a new homepage for the Database. Please browse the website of the database for the new features of the homepage. On the new homepage of the Database, we sent up an easy way for the public to get an overall picture on eighteen APEC member economies' competition policies and their laws. The public can get information related to competition issues either through browsing the Database or by initiating the search engine equipped within the Database. The newest design of the homepage is to incorporate member economies' updated news and events the section called "What's New". Currently, the "What's New" section includes information regarding activities and registration of �PEC Regulatory Reform Symposium" provided by New Zealand. it will be highly welcomed if member economies would like to provide us with information regarding new events related to competition policies and laws for inclusion in the "What's New" section. Member economies may e-mail us information which would be publicized on the Database through apecsys@apeccp.org.tw.

To increase the popularity of public access to the Database, Chinese Taipei bas sent out a request to the competent authorities all over the world for the two-sided linkage between the Database and their related websites.

Implementation Plan Toward Full Completion

The Chair's Summary Record of "APEC CTI First Meeting, held February 19-20", put the Chair's words that the Database was scheduled for completion by the end of 1998. The completion task of the Database was also recorded as a definite outcome in the CTI Chair' report to SOM (APEC Senior Officials Meeting). In order to meet the completion dateline, Chinese Taipei would like to propose an implementation plan including the required deadline for completion of categories 7-14 as follows:

  1. Category "Q&As" (category 07)
  2. This category includes questions and responses equally divided between those common to all economies and those that address issues specific to individual economies. The common questions are based on the "1994 Survey on Competition Law" conducted by New Zealand. The convenor has requested member economies to send their complete copy to Chinese Taipei for inclusion in the Database. However, some member economies only sent their updated responses but not a complete version, such as Singapore. Some member economies have not sent their full version of responses to us yet, such as Brunei Darussalam, Canada, Chile, Indonesia, Malaysia, Paupa New Guinea and Thailand. Chinese Taipei would like to request these member economies to send us such a copy of responses no later than October 10. A hard copy is also acceptable to us.

    Considering member economies' different development and enforcement experience of competition laws, we would suggest member economies pick up the most important issues for inclusion of sub-category "Particular Q & As" and then send a copy to us no later than November 10. Member economies could design their own particular Q & As to highlight their experience or discussion of competition policies and laws. The total number of particular Q & As are free to be prepared without being constrained to a number of fifty.

  3. Categories "Decisions of Administrative or Quasi-judicial Agencies" and "Judicial Cases" (categories 8,9)
  4. Member economies are requested to send us summaries of cases related to competition laws decided by the competent authorities or court, or approvals, advisory opinions, and interpretation rulings. Each case description should not exceed 2000 words. For those economies which have already implemented competition laws for years, please send us at least 5 to 10 cases for inclusion in the Database by the end of this year. As for economies which have not enacted competition laws, please still send some representative cases most related to the issue of competition policies and laws by the end of this year.

  5. Category "Issues Related to Competition Laws" (category 12)
  6. Member economies could send us information related to the following issues: anti-dumping and trade policies, consumer protection, intellectual property protection and so on by December 10. In particular, as for member economies who have not implemented competition laws, the current development of their efforts on such related issues are helpful for the public to keep eyes on their future of competition laws.

  7. Category "Statistical Data"(category 13)
  8. This is a useful category for comparing member economies' efforts on the development of competition policies and laws. Therefore, Chinese Taipei would like to request all member economies to send us their last year statistics on complaints, decisions, requests for advisory opinion or interpretations, applications other exemptions by the end of this year.

  9. Category "Announcement"(category 14)
  10. Since the Database has a new click board to incorporate member economies' new events, this category still welcome member economies to post their news or any tendency to the development of competition policies.

  11. Other Categories
  12. Due to the variety of data availability on the remaining categories, member economies can be selective in completing these categories but had better inform us if the data is available.

    To meet the completion deadline, Chinese Taipei would bear the cost of data transformation, if member economies only produced a hard copy of information. Electronic copy of information would be more welcomed. Member economies could send information through FIP (File Transfer Protocaol) or email to apecsys@apeccp.org.tw.

    A Proposal for Inclusion of Workshop Papers

    As we proposed at the June CTI Meeting, Chinese Taipei would like to add a category to the Database for inclusion of those papers presented at the "Competition policy and Deregulation Workshops". To provide the public an opportunity to access the contents of the discussion of member economies' competition policy and deregulation, we would like to seek member economies' collective authorization on the past and future Workshop's papers to be included into the Database. Our delegates would like to discuss such a matter with all member economies at the Workshop, and hope to reach a consensus on the issue.

    There is no delay for all member economies to commence the data transmission for the establishment of the second stage of the database. Only with all member economies' cooperation and support will the collection action plan for the Database be accomplished on schedule.
