Organization Structure
The competition organization of Thailand is composed of the Office of the Trade Competition Commission, the Trade Competition Commission, the Appellate Committee, and the sub committees are consisted of the Specialised Sub-Committee and the Inquiry Sub-Committee, please see illustration.
The
Office of the Trade Competition Commission
The Office of the Trade Competition
Commission, hereinafter �he Office of the TCC�� is located in the DIT. The
Director-General of the DIT is the Secretary �� General of the TCC who takes
responsible for administrative of the Act in order to monitoring competitive
conducts in Thai region, including submit the cases that may violate the Act
to the TCC for consideration.
The
Trade Competition Commission (TCC-Thailand)
The TCC has duties to independently enforce the Act and consider the
case based on case-by-case. The TCC is consisted of Minister of Commerce as
Chairman, the Permanent-Secretary for Commerce as Vice-Chairman, the Permanent-Secretary
for Finance as member, other 8-12 qualified persons as members who appointed
by the Council of Ministry as member, and the Secretary �eneral as member
and secretary. Nevertheless, the qualified persons selected as members are
not related to the political matters and at least a half of them are selected
from private sector. The qualified person selected as commissioner shall hold
office for a term of two years. The qualified
person selected as member may be re-appointed
but may not serve exceeding two consecutive terms.
The
Appellate Committee
The Council of Minister appoints
the Appellate Committee, hereinafter �he AC��, to reconsider the decision
issued by the TCC in order that the decision of the cases shall get the most
fairness. The AC is consisted of not exceeding 7 qualified persons who are
not related to political and the TCC matters.
A member of the AC shall
hold office for a term of four years. In the initial, at the expiration of
two years, three members of the AC shall vacate office by drawing lots and
such vacation of office by drawing lots shall be deemed to be the vacation
of office at the expiration of the term.
The
Specialised Sub-Committee
The TCC may appoint one or
more the Specialised Sub-Committee, hereinafter �he SSC��, to act as expert bodies for giving advice and suggestion.
The SSC is consisted of 4-6 persons who have knowledge and experience related
to the case matters and in such field as law, science, engineering, pharmacology,
agriculture, economic, commerce, accounting, and business administration.
The
Inquiry Sub-Committee
The TCC may appoint one or
more the Inquiry Sub-Committees, hereinafter �he ISC��, for investigative
procedure in anti-competitive cases. The result of investigation is submitted
to the TCC for consideration. The ISC is consisted of one person who is appointed
from police officials or public prosecutors with knowledge and experience
in criminal cases, one representative of the DIT, and other not exceeding
4 persons with knowledge and experience in economic, law, commerce, agriculture,
or accounting, total not exceeding six persons.
