- Directorate of Competition Policy
Duties: prepare and actuating study case industry and or business competition and give suggestion to government and interrelated to institution regarding the law No. 5 / 1999 implementation
- Advocation Sub Directorat
Duties: give an understanding and law service to public, government institution, non government institution and business actor.
- Industry Sub Directorat
Duties: prepare and actuating industry study case and suggestion to government and interrelated institution
- Regulation Sub Directorat
Duties: prepare and actuating in study case and suggest regulation recommend on regulation and law interrelated with business competition
- Law Institution Sub Directorat
Duties: prepare and actuating activity interrelated with business competition law
Organization Working Procedure
KPPU monitor and investigate cases interrelated with business competition. Citizen can report to KPPU by sending a letter to Head of Chairman. The report should contain:
- The name of the company
- Clausal collide in law no. 5/1999
- The activity collide in law no. 5/1999
- Identity of the sender
KPPU will investigate and decide whether the report collide the law no. 5/1999. If the report accepted in commission meeting as an activity collide, KPPU will choice a team work to handling the case. After all the evidence proof that the activity of the company guilty, KPPU will arrange and order the company to attend a trial. If the company objects with the commission decision, they can go to court of the first instance to read off the decision.
Cases Handling
There are many phases in a cases handling process based on The Commission Regulation No. 1 Year 2006. They are as follows:
- Case handling procedure is started with:
- Monitoring of Business Actors
The time limit is at the latest of 90 working days and could be extended for a maximum 60 working days.
- Report
- Clarification and completeness.
- The time limit is at the latest of 60 working days and could be extended for a maximum of 30 working days.
- Report and Monitoring Resume Filing
- The time limit is at the latest of 30 working days.
- The result of filing is infused on the Violation Allegation Report.
- Report presentation
The time limit is at the latest of 14 working days.
- Preliminary examination
The time limit is at the latest of 30 working days.
- Further examination
The time limit is at the latest of 60 working days and could be extended for a maximum of 30 working days.
- Court of commission counsel
Decision announcement is at the latest of 30 working days.
