COMPETITION POLICY STATEMENT

People's Republic of China


With a view to encouraging and protecting fair competition, defending the lawful rights and interests of operators and consumers, and safeguarding the healthy development of the socialist market economy, the law of the People's Republic of China for Countering Unfair Competition was adopted on 2 September 1993 at the Third Session of Standing Committee of the Eighth National people's Congress of China and entered into force on 1 December 1993. The promulgation and implementation of this law marks the preliminary establishment of a competition law system in our economy.

As the enforcement authority, the State Administration for Industry and Commerce嚗AIC嚗as done a lot of work through organizing the local administrative authorities for industry and commerce all over our economy, including enacting several rules, regulations and guidelines, dealing with case of monopoly and unfair competition. All these efforts has safeguarded the competition order and defended the lawful rights and interests of the operators and consumers.


Besides the enforcement of the Law for Countering Unfair Competition, we, together with other relevant departments, are in a process of drafting the Antimonopoly Law according to the legislation plan of the National people's Congress, I believe that the competition law system of our economy will improve gradually along with the emergence of the Antimonopoly law and relevant regulations.


SAIC shall strengthen multilateral and bilateral communication and cooperation with competition authorities in other economies in the process of legislation and enforcement of competition law. We shall also promote dialogue and understanding with relevant international organizations. It will of great help in promoting international trade and investment and creating a market environment with fair competition for various kinds of operators.
