Competition Tribunal


The Competition Tribunal (TDLC) is a special court that decides on competition matters and orders remedies and sanctions. It is an independent judicial body, subject to the supervision of the Supreme Court of Justice. The TDLC was created by Decree Law No. 19,911/2003.

The TDLC is headed by a Chief Judge or Chairman, and it has other four expert members, two economists and two lawyers, all of which are appointed for six-year terms. The Chairman must be a highly regarded lawyer with ten-year experience in competition matters, economic or commercial law. The appointment of the Chairman is made by the President of the Republic from a list of five candidates proposed by the Supreme Court of Justice, selected through a public contest. Two members are appointed by the Central Bank Council, after the examination of their qualifications through a public contest. The remaining two members are appointed by the President of the Republic, from two lists of three candidates each, proposed by the Central Bank Council after assessing their qualifications through a public contest.

The decisions of the Competition Tribunal are taken by the entire body, not by panels. Members of the TDLC serve nearly full time, although the post does not preclude the undertaking of other professional activities. They are called to attend meetings or hearings at least three times a week. In addition to the five judges, the TDLC has a staff of six professionals, lawyers and economists, headed by the Secretary of the Tribunal.

The 2009 amendments to the Competition Act seek to bolster the TDLC's functioning : the time its members have to commit to hear the proceedings have been increased, as have their salaries; the list of incompatibilities and inabilities of the Tribunal's members has been improved and extended, so as to ensure the members' independence and impartiality; and, new TDLC's procedural rules were introduced in order to enhance efficiency in the adjudication of competition matters (notification of resolutions, statute of limitations, and regulation of discovery, testimony of witnesses and other evidence).
