Development of Competition Law System in the Era of Globalization and Liberalization

Abstract

The purpose of our Fair Trade Law (competition law) is to maintain domestic trading order, protect consumer’s interest, ensure fair competition and advance economic stabilization and prosperity. Ever since its formation, the FTC has been dedicated to the enforcement of the Fair Trade Law and maintenance of trading order to ensure a liberal and fair competition mechanism. The FTC has also been actively participating in international communications regarding competition laws and policies to better construct a sound competition law system and create a liberal and fair competition environment and culture. However, with the constant change of international competition, the competition environment has become more diverse and complex. In addition, economic renovations, globalization and liberalization have caused the domestic socio-economic structure to have a dramatic change. The competition authorities of our country and other countries in the world have been challenged to enact appropriate competition policies and control the development of the competition law system. In order to effectively prevent all kinds of anti-competition behaviors worldwide and to protect our liberal competition environment and closely combine our competition law system with current economic development, this research will gather important development history of the competition law system and relevant academic research results domestically and overseas. This research will also study crucial issues currently existing in the world. “Development of Competition Law System in the Era of Globalization and Liberalization” shall be the subject of this research which will continue to put effort in promoting global socio-economic prosperity and growth through the study of each key issue. The study shall include the following key points:

1. Development of Competition Concept
   This study will employ more of an academic way to study the development of the competition concept and introduce how it is developed among economy and the law system.
2. International Development of Competition Law System
   This study will analyze, compare and categorize the current competition law system of other countries and refer to relevant theories given by experts and scholars in the recent years. It is to reveal the trend and full contents of the international development of competition law system for the reference of the FTC and all circles.
3. International Integration of Competition Law Systems
   The establishment of a competition law system is crucial to the overall economic development of a country. Whether a country is developed, developing or even underdeveloped, it should be fully dedicated to establishing competition policies that are suitable for its nation and international competition environment and should enact a set of proper competition regulations to promote the development and prosperity of the overall economy of this country. However, with the thriving commercial competitions brought by globalization and liberalization, in order to coordinate with the competent authorities of competition policy/law of each country in the world and maintain international competition order, this study will focus on the theories given by domestic and overseas experts and scholars to understand the development trend of the integration of international competition law systems and every possible problem to come in the future.
4. Development and Future of Our Competition Law System
   This study will focus upon the past and current development of our competition law system and refer to each key study mentioned above for better suggestions regarding the development of our competition law system in the future.
