CASE:
Importation of Aluminum Foil from Japan by Modern Paper Products with all the elements of dumping present. Protestant Reynolds Philippines Corporation initiates the protest with the Department of Finance. SUMMARY:
Modern Paper Products imported aluminum foils from Japan under such circumstances that all elements of dumping are present causing injury to the protestant Reynolds Philippines Corporation and prompting the latter to initiate a dumping protest with the Department of Finance. The document submitted established a prima facie case of dumping for which reason the case was referred to the Tariff Commission for investigation pursuant to Section 301 of the Tariff and Customs Code. The Department directed the Commissioner of Customs not to release any pending and subsequent shipment of aluminum foil from Japan. The Commission conducted the initial public hearing and during said hearing, the protestant manifested its willingness to negotiate for an amicable settlement of the case with the protestee. The request was granted. Upon submission of a written manifestation to the effect that in view of the amicable settlement reached, protest is withdrawn, this dumping protest is dismissed as recommended by the Chairman of the Tariff Commission.
