CASE:
    Importation of Bridgestone 1000 R20 16 PR Radial Steel Highway Design Tires from Japan. Protestant Tire Manufacturers Association of the Philippines filed the dumping protest with the Department of Trade and Industry. Sanctions imposable for violation of Section 301 of the Tariff and Customs Code but case dismissed in view of the withdrawal of the protest by the protestant.

SUMMARY:
    Tire Manufacturers Association of the Philippines (TMAP) filed with the Department of Trade and Industry a dumping protest against the importation of Bridgestone 1000 R20 16 PR Radial Steel Highway Design Tires from Japan. The Department of Finance, upon receipt of the protest, and finding a prima facie case of dumping indorsed it to the Tariff Commission for investigation. Simultaneously, the Department directed the Commissioner of Customs not to release any pending and subsequent shipments of subject article from Japan unless a bond in an amount equal to twice the estimated dutiable value thereof is filed. Investigation was conducted by the Commission, public hearings were held relevant information were gathered and analyzed. The protestant, however, failed to present evidence on the home consumption price of the subject article. Neither was the Commission able to secure the HCV despite repeated requests for assistance from the Department of Trade and Industry through the Bureau of Foreign Trade. In view of the failure to secure a certification on the HCV of subject tires, the protestant filed a motion to withdraw its protest. Dismissal is therefore recommended by the Commission without prejudice to the filing of a new case if evidence warrants.
