Resolutary Commission
Members: The Resolutary Commission is composed of the following members:
a) a Minister of the Supreme Court, appointed by this Court, who chairs it;
b) a Head of Service appointed by the Minister of Economy;
c) a Head of Service appointed by the Minister of Finance;
d) a Dean of the Faculty of Juridical and Social Sciences of an University seated in Santiago;
e) a Dean of the Faculty of Economic Sciences of an University seated in Santiago;
Functions: The Resolutary Commission have the authority to know ex officio or upon request of the Prosecutor of any situation that may infringe the Law, to investigate them with the largest powers (including those of requiring the help of the public force, even with the faculty of breaking into) and resolve about them.
This Commission is the only one that can apply administrative or civil sanctions, as well as require from the Prosecutor the exercice of the penal action. It has the superintendency of the Preventative Commissions, and is subject to the superintendency of the Supreme Court.
It has also the authority to (i) give instructions of a general character; (ii) make reports for the authorization of anti-competitive acts if the national interest requires it, or for the establishment of a monopoly (estanco); and (iii) require the modification or derogation of legal or regulatory provisions.
Operation: The Resolutary Commission gets together in the Court House of the Courts of Justice or in the public agency determined in an annual basis during its first session.
