Preventative Commissions
1 Regional Preventative Commission
Members: In each capital of region there is a Regional Preventative Commission which is composed of the following members:
a) the Ministerial Regional Secretary of Economy, who chairs it;
b) a member appointed by the Regional Intendent;
c) an university professional appointed by the Regional Development Council;
d) a representative of the Neighboring Juntas.
Functions: The Regional Preventative Commissions have preventative authorities and duties. They answer consultations on existing or to be proposed acts or contracts, and have the authority to know ex officio or upon request of any person, on any anti-competitive behavior. They can propose means to correct it, and require an investigation from the Prosecutor.
They may also, upon request of the Prosecutor, (i) resolve, for up to fifteen days extendible for an equal term, to suspend the implementation of contracts or to fix maximum prices; and (ii) request from any public organization or service the exercice of its regulatory faculties.
Operation: The Regional Preventative Commissions get together in the Intendency or in the seat agreed upon with the favorable vote of the member appointed by the Intendent.
2 Central Preventative Commission
Members: The Central Preventative Commission is composed of:
a) a representative of the Ministry of Economy, who chairs it;
b) a representative of the Ministry of Finance;
c) two university professors (a lawyer and a commercial engineer), appointed by the Rector's Council; and
d) a representative of the Neighboring Juntas.
Functions: The Central Preventative Commission acts as the Preventative Commission for the metropolitan area of Santiago and has all the functions confered to the Regional Preventative Commissions (see paragraph 1). It also intervenes if the case is of national character or involves more than one region.
Operation: The Central Preventative Commission gets together in the seat of the National Economic Prosecutor's Office.
